Stadium rawk titans The Foo Fighters have become embroiled in a dispute over their track 'My Hero' being used by US presidential candidate John McCain on his current campaign trail.

The band were upset by the Republican using the song in the wrong context, as Grohl has cited the lyrical content as being about ''the celebration of the common man and his extraordinary potential''. The band have said they only became aware of the tracks use after reading news reports and have said they were 'left in the dark' regarding the copyright of the song, taken from their second LP 'The Colour And The Shape'.

The McCain Machine have responded by adding ''the McCain-Palin campaign respects copyright, and has paid for licenses from performing rights organisations". Law and media litigation expert Steve Kuncewicz added further speculation to the case. "This is a major issue highlighting the grey areas around copyright and song ownership. Record companies are often slammed by bands for signing up to contracts without reading the smallprint. The furore sparked by this begs the question - who signed the deal?".

It is unknown whether McCain will continue to use the song for his own promotional gain, however the Foos have made it clear he is not their hero.
