Depeche Mode In Warcraft Court Case

British electro rock giants Depeche Mode have been dragged into a bizarre court case involving computer game World Of Warcraft.

Few would deny that The United States has a litigation culture. However few observers expected a case between World And Warcraft and one former user to drag in British group Depeche Mode.

Erik Estavillo has repeatedly sued games companies, alleging that their poor treatment of fans has caused him undue stress. Back in 2008 the gamer sued Sony after being banned from a Playstation game, alleging a violation of his First Amendment rights.

He lost, but un-deterred has launched several cases against other massive firms. Estavillo is now attempting to sue Activision Blizzard - the makers of hugely popular fantasy game World Of Warcraft.

The gamer alleges that the subscription fee is too high, while other elements of the game only exist to cost users money, reports Gamespot. Erik Estavillo argues that Activision Blizzard owe him money, and he intends to get it by calling some bizarre witnesses.

Claiming he is suffering from major depression, obsessive compulsive disorder, panic disorder, and Crohn's disease the gamer has called to his defence some celebrity figures.

Erik Estavillo has subpoenaed Depeche Mode multi-instrumentalist Martin Gore to appear in the case as an expert in alienation. The gamer claims he is calling Gore "since he himself has been known to be sad, lonely, and alienated, as can be seen in the songs he writes."

Also on the list of witnesses for the defence? Winona Ryder, who apparently once read 'The Catcher In The Rye' and is set to speak on "how alienation in the book can tie to alienation in real live / video games such as World of Warcraft."

Given the season of goodwill about to approach us ClashMusic suggests that Erik Estavillo introduce another expert witness - letters from every child in the United States!

Estavillo is seeking $1 million in damages.

Depeche Mode star Martin Gore has yet to comment.
